Short answer: THCA flower is illegal to buy, sell, or possess in Idaho. The state enforces a 0.0% THC standard for hemp products sold at retail — far stricter than the federal 0.3% Delta-9 limit — and classifies tetrahydrocannabinols, including THCA, as Schedule I controlled substances. Because heating THCA converts it into Delta-9 THC, THCA products fail Idaho's standard by definition. Elevate does not ship THCA products to Idaho.

Idaho's Zero-THC Retail Standard

Idaho has one of the most restrictive hemp policies in the country. Two rules work together:

  • Cultivation cap. Idaho Code §22-1703 limits cultivated hemp to 0.3% total Delta-9 THC by dry weight — and "total" includes the Delta-9 that THCA becomes after decarboxylation.
  • Retail standard. The Idaho State Department of Agriculture (ISDA) requires manufactured hemp products sold at retail to test at 0.0% THC. Any detectable THC takes a product out of compliance.

Most states adopted the federal 0.3% Delta-9 threshold from the 2018 Farm Bill. Idaho did not. Its 0.0% retail rule is the controlling standard for anything sold inside the state.

Why THCA Specifically Fails in Idaho

THCA is the raw, non-intoxicating acid form of THC. When it is heated — smoked, vaped, or cooked — it decarboxylates into Delta-9 THC. Idaho measures total THC on a post-decarboxylation basis, so high-THCA flower is treated as THC-containing material. That pushes it past both the 0.3% cultivation cap and the 0.0% retail standard, and tetrahydrocannabinols sit in Idaho's Schedule I.

Penalties for THCA Possession in Idaho

Idaho enforces its controlled-substance laws under Idaho Code §37-2732:

  • Three ounces or less: a misdemeanor, with a minimum $300 fine.
  • More than three ounces: a felony, punishable by up to five years in prison and a fine of up to $10,000.

Because THCA flower looks like marijuana and tests as THC-containing once heat is applied, Idaho law treats it accordingly.

Can You Order THCA Online and Ship It to Idaho?

No. A package crossing state lines does not change Idaho's standard — possession inside the state is what matters, and THCA products do not meet the 0.0% retail rule. Retailers that ship otherwise-compliant hemp generally exclude Idaho for this reason. Elevate does not ship THCA products to Idaho.

THCA Product Status in Idaho (2026)

Product Status Notes
THCA flower Illegal Fails the 0.0% retail THC standard; tetrahydrocannabinols are Schedule I
THCA pre-rolls Illegal Same standard as flower
THCA vapes and carts Illegal Converts to Delta-9 THC when heated; non-compliant
THCA concentrates (dabs, rosin, diamonds) Illegal Same standard; high THC content
THCA edibles and gummies Illegal Any detectable THC fails the 0.0% retail standard
THCA tinctures Illegal Same standard
CBD products Legal only at 0.0% THC Zero-THC CBD is permitted; any THC content is non-compliant

The common thread: anything with detectable THC — including the THC that THCA becomes when heated — fails Idaho's 0.0% retail standard. Only hemp products that contain no THC at all, such as certain CBD isolates, can be sold in the state.

What the 2026 Federal Change Means for Idaho

Federal H.R. 5371 §781, signed November 12, 2025 and effective November 12, 2026, replaces the old Delta-9-only federal test with a total-THC standard and caps finished hemp products at 0.4 mg total THC per container. Even under that stricter federal rule, Idaho's 0.0% retail standard remains controlling for products sold in the state — so the change does not open an Idaho market for THCA.

Frequently Asked Questions

Is THCA legal in Idaho in 2026?
No. Idaho enforces a 0.0% THC retail standard and lists tetrahydrocannabinols as Schedule I, so THCA flower and other THCA products cannot be legally sold or possessed.

Why is Idaho stricter than other states?
Most states use the federal 0.3% Delta-9 limit. Idaho requires retail hemp products to contain 0.0% THC, and it counts the THC that THCA becomes after heating.

Can I have THCA shipped to Idaho?
No. THCA products do not meet Idaho's standard, and shipping one into the state does not make possession legal.

What is the penalty for THCA in Idaho?
Three ounces or less is a misdemeanor with at least a $300 fine; more than three ounces is a felony carrying up to five years in prison and a fine of up to $10,000.

Is CBD legal in Idaho?
CBD is legal only if it contains 0.0% THC and meets the state's other requirements. CBD products with any detectable THC are not compliant.

Does Elevate ship THCA to Idaho?
No. Because Idaho's 0.0% retail standard makes THCA non-compliant, we do not ship THCA products to Idaho.
