What HB 445 Changed
House Bill 445, enacted in 2025, replaced Alabama's loosely regulated hemp market with one of the strictest frameworks in the country. It rolled out in two phases:
- July 1, 2025 — Smokable ban. Every smokable hemp product became illegal: THCA flower, pre-rolls, hemp cigarettes and cigars, and inhalable vapes in practice. Possession became a felony overnight.
- January 1, 2026 — Full regulatory system. The remainder of HB 445 took effect: licensing through the Alabama ABC Board, lab-testing and packaging requirements, a 21-and-over age limit, total-THC potency caps, and a ban on online sales and direct shipment of consumable hemp to Alabama consumers.
As of 2026, the law is active and being enforced. Hemp companies have challenged HB 445 in court on constitutional grounds, but those challenges have not paused enforcement.
Penalties for Smokable THCA in Alabama
Under HB 445, possessing or selling smokable THCA is a Class C felony. Penalties can include:
- One to ten years in prison
- Fines up to $15,000
- Warrantless seizure of any product that lacks a Certificate of Analysis
That is a harsher classification than personal-use marijuana possession in Alabama, which remains a Class A misdemeanor carrying up to one year in jail. Selling consumable hemp without an ABC Board license is also a Class C felony.
Can You Order THCA Online and Ship It to Alabama?
No. Since January 1, 2026, HB 445 has prohibited online sales and direct shipments of consumable hemp products to Alabama consumers. That prohibition covers every THCA format — smokable and non-smokable alike. Smokable forms were already banned six months earlier, on July 1, 2025.
If a website offers to ship THCA flower, vapes, or pre-rolls to an Alabama address, that order does not comply with state law. For that reason, Elevate does not ship THCA products to Alabama.

"Total THC" combines THCA and Delta-9 THC. Any product above the cap is illegal in Alabama regardless of its form.
Where Alabama Residents Can Legally Buy Non-Smokable Hemp
The only lawful path to buy non-smokable THCA in Alabama is in person, from a retailer licensed by the Alabama ABC Board, with products that stay under the 10 mg total-THC-per-serving and 40 mg-per-container caps. Two things to avoid:
- Gas stations, convenience stores, and unlicensed smoke shops. These are not licensed under HB 445, and product sold there is treated as contraband.
